Who the agreement is with

The supplier is EGENFORM GAARDER, Norwegian organisation number 838 405 282 («Egenform»). Registered business address: c/o Hans Robert Cunanan Gaarder, Olav M. Troviks vei 28B, 0864 Oslo, Norway. Contact us at [email protected]. These terms apply to website subscriptions purchased for business purposes. You confirm that you are authorised to enter the agreement for your business. This offer is not designed for personal consumer purchases. Before payment, we check the business and the establishment receiving the service. If manual verification is needed, you are not charged while it is pending. Contact us if your legal business name, receiving establishment or tax details change.

For standard orders, we create a concrete offer summary from your business, goal and selected features. You see the deliverables, exclusions, price and billing start before ordering and saving your card. The accepted version is retained as part of your agreement. Individually agreed written terms take precedence over these standard terms where they conflict. Please contact us before ordering if anything in the summary or card setup does not match.

What is included

The standard subscription includes the design of one mobile-friendly web page with up to six sections, a contact form, hosting, SSL, publication at a working website address and technical maintenance. Website availability checks are included as described in the operations section. Two consolidated revision rounds are included: each round is one combined set of feedback with changes within the agreed scope. The rounds become available in your account once the website is published and the first payment is confirmed. Publication does not use up the rounds. These are two rounds in total, not two new rounds every month. Unused rounds within the agreed scope remain available while your subscription is active; closing setup does not remove unused rounds. Faults in the agreed delivery are handled under the section on faults and breach, and are not treated as purchases of a new feature.

The offer summary shown before ordering identifies what is included in your order. Ordinary operation and the included publishing address do not require an extra purchase. Ongoing content changes after setup, additional pages or sections and extra revision rounds require separate agreement. A custom domain is optional; you can register or renew one directly with a registrar, or separately agree an explicit price with us. All additional work and third-party costs must be agreed before ordering; submitting a request does not itself purchase an extra service.

E-commerce, customer accounts, an embedded booking engine and custom integrations require a separate quote. Those needs are submitted as a non-binding quote request; the standard subscription is not charged in that flow. A normal link to an existing external service is different from building or integrating that service.

Your account shows available, reserved and used revision rounds. Submitting a revision round reserves it for that request. It is counted as used when Egenform starts the agreed revision work. If the request is cancelled before work starts, the round is released. If work has already been done, we explain what was completed before agreeing how to handle anything remaining. Correcting faults for which Egenform is responsible does not consume revision rounds.

You can report technical bugs in your account without buying a revision round. Issues covered by technical maintenance or faults in the agreed delivery are handled without an extra charge. A request for new functionality is a change request and does not become a paid job until you accept a concrete offer.

Extra revision rounds and other website changes can be quoted separately in your account. Before payment, the quote shows the exact scope, final price, currency and whether the purchase covers one extra revision round tied to that specific request, or the described change without a revision round. A purchased round covers the accepted scope and does not automatically transfer to a different job. A one-off payment does not create a new subscription or restart the minimum term. Agreed work is carried out after payment is confirmed; any delivery arrangements appear in the quote.

Prices, taxes and payment

SubscriptionMonthly, months 1–12Monthly, from month 13Setup12-month minimum total
With setup fee (Starter)USD 59USD 59USD 299 onceUSD 1,007
No setup fee (Complete)USD 99USD 59USD 0USD 1,188

Complete automatically drops from USD 99 to USD 59 per month from the start of the 13th subscription month. The lower price covers continued monthly service with the same agreed features and scope. You do not need to switch plans or request the reduction. There is no new setup fee and the minimum term does not restart. Starter continues at USD 59 per month. Subscription months run from the first paid subscription period after publication. Time spent building the website is not counted.

All table amounts are final customer prices. Any VAT or other tax Egenform is required to collect is included in these amounts, rather than added afterwards. The minimum total includes 12 monthly payments and any setup fee, but excludes optional extras and continued service after 12 months. You pay USD 0 when you order and save your card. The first payment after publication is USD 358 with setup or USD 99 without setup. Your agreed currency, final price and any tax breakdown are shown before you pay. Egenform does not add a separate card or payment-processing fee to these prices.

For cross-border business purchases in the EU or UK, your business may need to account for local VAT under the reverse-charge rules. Any such VAT is your local responsibility and is not collected by Egenform. We disclose this before ordering where applicable. Our fixed price does not remove your own tax obligations.

Stripe processes payments. When ordering, you register a card with Stripe without a charge from Egenform. In a separate confirmation, you authorise Stripe to save the payment method for Egenform and Egenform to charge the agreed first payment once your website is published and linked to your account, then the monthly price in advance each month. These charges may happen while you are not logged in. The confirmation shows the first amount, currency, monthly price, any setup fee, automatic price reduction and minimum term. This authorisation does not cover optional extras; they require separate price approval. Your bank may require you to authorise a payment separately. You can update your payment method and download invoices through the billing portal. A missed or declined payment does not cancel an active subscription.

Subscription start and minimum term

Creating an account is free. For a standard order, you accept the offer summary, terms and authorisation for later payments, and register a card with Stripe. Ordering and saving a card start neither payment nor the minimum term. You can then supply text, images, brand assets and domain details in your account. We agree a delivery date once the necessary content has been received.

The first payment and 12-month minimum start only after the website is published. Egenform links the published address to your account, checks that it responds and confirms that it is the agreed website before activating the subscription. A saved address or draft alone is not enough. The first invoice covers one month of service and any agreed setup fee. Once payment is confirmed, the start of that first paid period is the start date for monthly billing and the 12-month minimum term. Your account shows the start date and website address.

If the first payment needs authorisation or fails, payment must be resolved before the subscription is considered active and the included revision rounds become available. Time before publication is not charged retrospectively. Delayed content from you can postpone publication and therefore the billing start. Egenform must not start charging simply because a certain time has passed since the order.

The portal provides an overview and a place to request changes, rather than a page builder that publishes changes automatically. A material delay on our side is handled under the section on faults and breach. After the minimum term, the subscription continues monthly until cancelled, at the price shown above for month 13 onwards. The agreed one-calendar-month notice period still applies.

How to cancel

Before activation: You can cancel an order awaiting publication and subscription activation in your account or by contacting us. Cancellation prevents later activation and charging for that order; neither the first month nor setup fee is charged. Once activation has already started after publication, the rules below apply to the subscription being started. Any separate extras remain subject only to their own expressly accepted agreement.

You can give notice at any time in the customer portal or by email, including during the first 12 months. The notice period is one calendar month. Your end date is the later of the minimum-term end and one calendar month after we receive notice. It is not rounded up to the next full billing month. Any shortened final billing period is prorated. If the corresponding day does not exist in the next month, its last day is used.

The portal displays your actual end date before confirmation. Service and the agreed payments continue until that date. For notice by email, we confirm receipt and the end date in writing. Notice received at least one month before the minimum term ends can take effect at the end of the 12 months; a thirteenth month is not added automatically.

If an already paid monthly period covers time after the confirmed end date, we correct the unused part with a credit note and refund. When the refund appears in your account depends on Stripe and your bank or card issuer. The portal distinguishes a refund in progress from a confirmed refund. We follow up failed or uncertain results; a missing response does not by itself trigger a duplicate refund.

Deleting your login, blocking a card payment or asking to hide the website does not by itself end the payment agreement. Contact us if you think an end date is incorrect. Mandatory legal rights and a separately agreed earlier termination take precedence over the standard calculation.

Your website, content and domain

You retain ownership of your own domain, trademarks and material you provide, including text, images and customer data. You give us the permission necessary to build and operate the agreed website. You are responsible for having the rights to the material you ask us to use and for the accuracy of your business information.

The website design, code and use of the solution are provided as a subscription service. Rights to Egenform materials and third-party components do not automatically transfer when the subscription ends. Egenform retains rights to its own design and technical solution. Any buyout or transfer of the solution is optional and requires a separate written agreement; it is not included and no fixed buyout price is promised. Continued hosting or delivery of source code must also be agreed separately.

When the service ends, we agree how to handle publication, the domain and delivery of your content. The cancellation button does not immediately delete your website or domain. Hosting and the right to use the service may end on the confirmed end date after the consequences have been explained to you. Permanent deletion of website content or changes to/deletion of a domain registration are not hidden side effects of cancellation; specific arrangements are confirmed first. Extra migration work must be priced and agreed before it is carried out.

Operation and website status

Availability status reports the most recent check of your website’s approved address and the time of that check. It is not a continuous uptime guarantee and does not test every website function. An “unknown” status means a reliable check is not available.

We follow up reported operational issues and faults within your agreed service. We do not promise round-the-clock support, specific response times, search rankings, traffic or sales without an express written agreement. Planned maintenance and issues with internet, domain or cloud providers can affect availability.

Safe use and personal data

Protect access to your email account: portal sign-in uses a one-time code sent by email. Never share that code. Tell us promptly if you suspect misuse. We may temporarily restrict access where necessary to handle a specific security incident and will inform you as soon as it is safe to do so.

Personal information about business contacts and portal users is handled as described in the privacy notice. The data processing agreement for the standard contact form below forms part of these terms and applies when Egenform handles those enquiries on your business’s behalf. Other processing purposes or features must be agreed separately before use. Do not send sensitive personal information or secrets in ordinary change requests.

Deleting your account

You can request account deletion in the portal. We explain what the action includes before it is completed. If active services or contractual obligations need to be resolved, your request is recorded and followed up. Information no longer needed should be deleted even when some contract or accounting records must remain.

Account deletion does not erase accounting records or other information we have a documented legal obligation or necessary lawful reason to retain. This is not permission to retain every profile detail indefinitely. The privacy notice explains purposes, retention and your rights.

Faults, delays and material breach

Tell us about faults or discrepancies promptly, with enough detail for us to investigate. We must have a reasonable opportunity to put right issues for which we are responsible. In the event of a material breach, the other party may request a remedy within a reasonable written deadline and, if the breach is not remedied, seek termination of the affected agreement and any other remedies available under applicable law.

For overdue payments, we give notice and a reasonable opportunity to resolve the issue before restricting or suspending service. Disputed invoices are handled separately; please explain what you believe is wrong. Faster restrictions may be necessary for an urgent security issue or unlawful use. These terms do not exclude rights that cannot lawfully be waived.

Changes and disagreements

Prices and agreed scope do not change retrospectively. Changes to an ongoing paid agreement require a lawful basis and clear notice or written agreement. Publishing a new version of these terms does not by itself change an existing binding proposal.

Norwegian law governs the agreement, subject to any rules that apply regardless of that choice. Contact [email protected] with questions or complaints so that we can try to resolve the matter in writing. If that is unsuccessful, the matter may be brought before a competent court under the applicable rules.

Data processing agreement for the standard contact form

Parties and effect. This annex is the data processing agreement for the included standard contact form. It is part of accepting the offer and these terms, with no additional order. The customer identified in the accepted order is the controller; EGENFORM GAARDER is the processor. This annex takes precedence over other standard terms for this processing. The privacy notice covering Egenform’s own customer relationship is separate.

Task, data and duration. The instruction is to receive enquiries through the customer’s published standard contact form, check for abuse, transmit them to the customer’s agreed recipient address, and perform necessary troubleshooting and secure operation. Data subjects are visitors, prospective customers and other people contacting the business. Data consists of name, email address, optional phone number and business name, message content, time and necessary delivery/security information, including IP address. The form must not request national identification numbers, payment-card details, health information or other special-category data. Processing continues while the form is operated and afterwards only as needed for agreed return/deletion or legally required retention.

Customer responsibility and instructions. The customer decides the purposes, agreed form fields and recipient address, establishes a lawful basis and provides visitors with appropriate privacy information. This annex and the customer’s documented recipient/form settings are the initial instruction. New purposes, sensitive content, additional recipients or integrations must be agreed in writing before use. Egenform processes only on documented instructions, including for transfers, unless binding law requires otherwise; where permitted, the customer is informed beforehand. Egenform promptly informs the customer if it considers an instruction unlawful. We do not use form data for our own marketing, model training or a separate customer database.

Confidentiality and security. Only authorised people with a work-related need receive access and must be bound by continuing confidentiality duties. Egenform must maintain risk-appropriate Article 32 safeguards, including HTTPS transmission, protected server credentials, access controls, data minimisation, limited logging and abuse protection. The recipient address is checked with the customer before publication. We must review safeguards and address vulnerabilities. The customer secures its own recipient mailbox and access to it.

Subprocessors. The customer gives general written authorisation to use Cloudflare for hosting, traffic protection and transmission, and Resend for email delivery, together with necessary subprocessors identified in their processing terms and subprocessor lists. Only providers needed for the described task are used. Egenform imposes equivalent data protection obligations through written agreements and remains responsible to the customer for their work. Before adding or replacing a subprocessor, Egenform must provide written notice with relevant information and at least 14 days to raise a reasoned data-protection objection. If the customer objects, the parties seek a lawful solution before the change is used for that customer’s data; the affected processing must be limited or ended if no appropriate solution exists.

Locations and transfers. Cloudflare operates an international network. Resend states that its primary processing takes place in the United States. This agreement therefore does not promise EEA-only processing. Transfers must use a current lawful mechanism, such as an applicable adequacy decision or EU Standard Contractual Clauses with necessary supplementary measures. Egenform must document the provider agreements, subprocessors and safeguards used, and provide information and copies of relevant safeguards on request. Provider terms: Cloudflare and Resend. Those links are not a general certification of the customer’s use.

Assistance and incidents. Egenform forwards requests concerning form data to the customer without undue delay and assists, taking account of the processing and available information, with access, correction, export, deletion and other rights. We also assist with relevant Article 32–36 duties, including security assessments, impact assessments and prior consultation. Egenform informs the customer of a personal data breach without undue delay and supplies available information about the event, affected data/people, likely consequences and measures, with updates as more becomes known. The customer decides whether to notify authorities and individuals, with necessary assistance from Egenform.

Retention, return and deletion. Form messages are not accounting records simply because the customer has a subscription. Egenform must limit its delivery logs and troubleshooting copies to what is necessary and follow up deletion with subprocessors. On termination, the customer’s default instruction is to receive any remaining form data Egenform holds on its behalf, followed by deletion of Egenform’s copies. The customer may instead request direct deletion. This is completed without undue delay and documented; only legally required retention is excepted. Actual subprocessor and backup completion periods must be disclosed rather than described as instantaneous deletion. Any copies being phased out are isolated from ordinary use. Emails already received by the customer are managed by the customer and its mailbox provider.

Review and termination. Egenform must provide the information needed to demonstrate compliance with Article 28 and allow and contribute to audits or inspections by the customer or an independent auditor it appoints. Practical arrangements must protect other customers’ information without obstructing a necessary review. If Egenform can no longer process lawfully, the customer may instruct processing to stop and terminate the affected processing arrangement. Mandatory legal restrictions and rights take precedence over other terms.
